Procurement Monitoring Bureau sees no violations in „Rīgas satiksme” fuel tender
„Rīgas satiksme” informs that on September 4, 2015 it received a resolution of the Procurement Monitoring Bureau (PMB) which allows „Rīgas satiksme” to continue the diesel fuel procurement procedure for the period of five years. The resolution of the PMB states that it does not see any violations of law in „Rīgas satiksme” public procurement procedure, yet at the same time it points out that it is necessary to check whether one of the tender participants, SIA „East-West Transit”, has tax debts.
The public procurement commission of „Rīgas satiksme” announced the diesel fuel public procurement procedure on May 22, 2015. The tender was organised as required by the Law on procurement of public service providers. It is planned that as a result of the tender a public contract on the delivery of diesel fuel to „Rīgas satiksme” fuel stations will be signed for a period of five years. The contract provides for the delivery of about 12 million litres of diesel fuel meeting seasonal requirements during a year. The estimated amount of the contract is EUR 60 million.
The offers were submitted by four tenderers: SIA „East-West Transit”; SIA „RDZ Energy”, SIA „Orlen Latvija” and SIA „Statoil Fuel & Retail Latvia”. The offers were evaluated by the procurement commission established by „Rīgas satiksme”. After evaluating the conformity of the bidders to the requirements of the tender rules, SIA „East-West Transit” was excluded from further participation in the tender, because according to the information contained in the publicly available data bases of the State Revenue Service, SIA „East-West Transit” had a tax debt and was put on the list of major tax debtors as on August 1, 2015.
Having evaluated the conformity of the financial proposals of three remaining bidders to the requirements of diesel fuel pricing mechanism, the commission identified and corrected arithmetic mistakes in the proposals, which the PMB recognised legitimate. Based on the evaluation made by the commission, the proposal of SIA „RDZ Energy” was recognised the most economically advantageous.
SIA „East-West Transit” submitted an application to the PMB, in which it disputed the decision of the committee to exclude it from the tender for tax debts. Meanwhile SIA „Statoil Fuel & Retail Latvia” disputed the correction of arithmetic mistakes by the commission.
